How IRS Schedule C and 1099 rules work for a US web design agency
Schedule C, 1099-NEC filing, worker classification and quarterly estimated taxes decide what a US web design agency keeps. Here is how each works.
Use the branches in sequence: first identify the agency's federal tax status, then decide how to classify people it pays, report receipts and costs, and handle estimated tax. More than one branch may apply. This is a federal decision path; state rules can add separate obligations, especially for worker status and sales tax.
If the agency is taxed as a sole owner
If the agency is a sole proprietorship or a one-member LLC with default federal treatment, report its business result on Schedule C attached to Form 1040. A corporation follows a different federal filing route and usually runs payroll, so settle the entity's tax treatment before using the remaining branches.
Choose cash or accrual accounting in Part I. Many small agencies use cash accounting, recognizing income when received and costs when paid. Report gross client receipts before taking out payment-processing fees; referral-generated payments also count as business receipts, including income from a web design referral program.
Key Schedule C Lines
- Line 1Gross receipts
- Line 7Gross income
- Line 30Total expenses
- Line 31Net profit or loss
Schedule C lines 2 through 6 cover returns, allowances and cost of goods sold, which a service agency usually leaves blank. Line 7 is gross income, line 28 totals expenses and line 29 gives the tentative profit. Line 30 is the home-office deduction, and line 31 records the final profit or loss. That net result carries to Schedule SE and Form 1040.
- Line 8
- advertising, including Google Ads and directory listings.
- Line 10
- commissions and fees, including payment processor fees.
- Line 13
- depreciation on computers and cameras over their useful life.
- Line 18
- office expense, such as paper, ink and small supplies.
- Line 20b
- rent or lease for office space or equipment.
- Line 24a
- travel, including airfare and hotels; line 24b holds deductible meals.
- Line 27a
- other expenses, itemized on Part V.
- Rule of thumb
- include client receipts before subtracting payment-processing fees.
If an agency purchase may be a business cost
If a purchase supports ordinary and necessary agency work, assign it to the matching Schedule C category and retain proof of payment. Under cash accounting, software paid for during the year may include design tools, project-management apps, hosting, domain registrations, code editors and stock-asset services.
Treat equipment differently from recurring operating costs. A laptop, monitor or camera used only for business may qualify for a purchase-year deduction through Section 179 or bonus depreciation. For property placed in service in 2025, the Section 179 limit is $2,500,000 after the 2025 tax law changes, and bonus depreciation is 100 percent for property acquired after January 19, 2025. Property acquired before that date uses 40 percent. Publication 334 and the Form 4562 instructions describe these choices, and the acquisition date decides which percentage applies.
- Subcontractor costs go on line 11 as contract labor. Compare freelancers and staff when choosing how to resource projects.
- A home office may use the simplified method, $5 per square foot up to 300 square feet, or the regular method based on the space and tracked utilities, rent and repairs.
Deductible Studio Costs
- Software subscriptions in year paid
- Subcontractor payments on line 11
- Equipment via Section 179 or bonus
- Home office simplified or regular method
- Insurance, courses, bank fees
- Hosting, ad spend, contract labor
For the home-office deduction, the space must be used regularly and exclusively for business: a kitchen table does not pass that test, while a dedicated spare room can. Keep receipts and bank statements for each expense category. A separate business account makes those records easier to trace and review.
Compare spending on tools with agency wages and labor costs before filing. This helps distinguish recurring software and supplies from equipment, rent and contractor costs, while preserving the paperwork that supports each amount reported on Schedule C.
- Rule of thumb: claim agency costs only when records support the amount and business purpose.
If another person carries out agency work
If you direct how a person works, do not rely on the contract label alone. Federal classification weighs behavioral control, financial control and the relationship between the parties; state tests may be stricter. The IRS common-law test is explained in Publication 15-A, and a business or worker can ask the IRS for a determination on Form SS-8. The Department of Labor applies a separate economic reality test under the Fair Labor Standards Act. Assess the actual arrangement before deciding whether the person is an employee or an independent contractor.
Employee or Contractor?
Do you set hours and train them?
Employee
Contractor
- Behavioral controlcheck whether you set hours, require office attendance or teach the person your process.
- Financial controlconsider whether the person has other clients, sets rates, buys equipment and can make a profit or loss.
- Relationshipconsider the written agreement, benefits and whether the work is a permanent part of the agency.
A designer working only for the agency, following its schedule and using its tools points more toward employee status. Someone with an independent studio, several clients and their own software points more toward contractor status. Use a reliable hiring process to find suitable people, but base classification on the working relationship.
If the person is an employee, the agency withholds income tax using Form W-4 and withholds and matches Social Security and Medicare tax. It reports wages on Form W-2, files Form 941 each quarter and Form 940 for federal unemployment tax, and checks work eligibility on Form I-9.
Misclassification can lead to back employment taxes, penalties and interest. If the person is genuinely independent, the agency may still have information-return duties based on the kind and amount of payment. Where the work takes place also matters, because state tests may differ from the federal approach.
- Rule of thumb: decide from the real work arrangement, not the wording of the contract.
If you paid a designer or another outside provider
If you paid a contract designer, developer, copywriter or photographer $2,000 or more for work paid in 2026, generally file Form 1099-NEC. For payments made in 2025 and earlier years the threshold was $600. The $2,000 figure is indexed for inflation from 2027. Send the contractor their copy by January 31 of the following year. The IRS general instructions for Information Returns (2025) explain form choices and exceptions.
1099-NEC vs 1099-MISC
1099-NEC
- Purpose
- Nonemployee comp
- Threshold
- $600 or more
- Deadline
- January 31
- Example
- Contract designer
1099-MISC
- Purpose
- Rent, royalties
- Threshold
- $600 or more
- Deadline
- Varies
- Example
- Office rent
| Payment type | Form | Threshold |
|---|---|---|
| Contract designer or developer | 1099-NEC | $2,000 or more (2026 payments) |
| Freelance copywriter | 1099-NEC | $2,000 or more (2026 payments) |
| Office rent to a landlord | 1099-MISC | $2,000 or more (2026 payments) |
| Royalties for licensed work | 1099-MISC | $10 or more |
| Payment to a corporation for design | Usually none | n/a |
| Payment through a payment network | Usually none | n/a |
Use Form 1099-MISC for rent, royalties, prizes and certain legal settlements, rather than contract design work. Payments to a corporation for design services are generally exempt from 1099-NEC, with attorney and medical payments as exceptions. Payments routed through a network that issues its own 1099 may also be exempt.
Collect the contractor's legal name, address and taxpayer identification number on Form W-9 before the first payment. A missing TIN may require backup withholding. Form 1099-NEC is due to the IRS by January 31 whether filed electronically or on paper, which is the same deadline as the contractor's copy. Paper filers also send Form 1096. The end-of-February date applies to Form 1099-MISC filed on paper, not to the NEC. Late or missing forms can bring penalties of $60 within 30 days, $130 after that through August 1, and $340 after that or for non-filing; amounts are indexed for inflation.
- Rule of thumb: collect the W-9 first, then check the payment type and annual total.
If no tax is withheld from client payments
If clients pay the agency without tax withholding, consider estimated payments as income is earned. The regular deadlines are April 15, June 15, September 15 and January 15 of the following year. If a due date lands on a weekend or holiday, payment is due on the next business day.
Quarterly Estimated Tax Dates
- April 15First payment due
- June 15Second payment due
- September 15Third payment due
- January 15Fourth payment due
Pay each installment with Form 1040-ES or through IRS Direct Pay, using either last year's tax liability or an estimate of current-year income. Safe-harbor payments can avoid a penalty if they reach 90 percent of this year's liability or 100 percent of last year's. The prior-year target rises to 110 percent when adjusted gross income was above $150,000, or $75,000 for married taxpayers filing separately.
Self-employment tax funds Social Security and Medicare, separately from income tax. The rate is 15.3 percent on net earnings up to the Social Security wage base, then 2.9 percent for Medicare earnings above it. The base was $176,100 for 2025 and is $184,500 for 2026. The rate applies to 92.35 percent of Schedule C net profit. Schedule SE calculates the amount from Schedule C profit, and half of this tax is deductible on Form 1040.
If you also have W-2 wages, those wages combine with Schedule C profit and can affect your tax bracket and eligibility for some credits. An S corporation election may sometimes reduce self-employment tax on distributions, but ask a CPA to run the figures before choosing that route. Some owners move part of each client payment into savings when an invoice clears.
- Rule of thumb: estimate tax from expected profit and calendar all four payment dates.
If the agency needs an identifier and traceable records
If the owner needs an identifier for contractor forms, a sole proprietor can use an EIN, a separate nine-digit number, instead of a Social Security number. The IRS issues it free. A single-member LLC without employees may use the owner's SSN, although banks and clients often prefer an EIN.
An EIN is required for corporations and partnerships, employers, and people filing certain excise or pension returns. If forming an entity, register with the state Secretary of State before applying online. State LLC registration commonly includes a registered agent and filing fee, which belong in your agency startup costs and funding.
Set Up Clean Records
- Open dedicated business checking account
- Use business credit card for expenses
- Save every receipt and invoice by month
- Track contractor payments with name, amount, TIN
- Reconcile monthly to bank statements
- File 1099-NECs by January 31
- Store tax records at least three years
- Open a business checking account and route client payments through it.
- Transfer a set share of each deposit into savings for estimated tax.
- Request a Form W-9 from each contractor before the first payment.
- File receipts by Schedule C line or tag them in bookkeeping software.
Clean records can also help with financing or a business credit card, because lenders want statements rather than an disorganized pile of receipts. Keep business expenses traceable to categories, not simply grouped as one broad outlay; this supports practical recordkeeping for filing and review. For setup context, see how to start an agency and SBA growth programs.
Federal filing does not settle every state question. After Wayfair, a state may require sales-tax collection based on economic nexus despite no physical presence there. Check the relevant state sales-tax rules for applicable thresholds and obligations.
- Rule of thumb: separate business funds and connect each receipt to a reported category.
